Expert Witness
Bob is an experienced expert witness and is a Practicing Associate of the Academy of Experts. He has so far carried out three expert witness assignments:
1. EDS v NATS
His first case was on behalf of EDS in their claim against NATS alleging wrongful termination of their PFI contract to develop the Oceanic Air Traffic Control System. He was brought into the case to assist the main expert, Dr Mark Vaughn, because of his air traffic control expertise. His involvement started in March 2001 and continued until the case settled in April 2002. During this time he was intensively involved in forensic analysis and providing opinion on a range of issues although focussing mainly on the project management and development processes used by EDS and the feasibility of their plans for completing the work at termination. He drafted several sections of the Expert Reports (first and responsive) and attended some meetings with the other side’s expert. He also attended court on several occasions and assisted the barristers on some technical matters. The case was heard by His Honour Judge Toulmin CMG QC and settled after 43 days in court just prior to experts' evidence.
2. Arbitration (parties confidential)
Bob's second case was an arbitration (before His Honour Judge Humphrey LLoyd QC) therefore the parties concerned must remain confidential. In this case he was instructed in his own right by CMS Cameron McKenna as the programme and project management expert on behalf of the Respondent. The case involved, inter alia, supply of point of sale terminals, back-office accounting and associated software as part of a large consortium-based PFI project. Bob again worked with Dr Vaughn who was the instructed technical expert in the case. He was fully responsible for conducting delay analysis and providing expert opinion and reports on the causes of alleged delays in the programme. There was an extremely large number of programme plans (MS Project and Primavera P3 produced by both sides covering some 50 periods from contract award to termination by the Respondent). The assignment ran from November 2003 to October 2004 and was settled in mediation just before the arbitration hearing was due to start.
3. Cambridge Online Systems Ltd v West Bromwich Albion Football Club Ltd
Bob was the technical expert instructed on behalf of West Bromwich Albion. The case involved supply of a ticket office system coupled with a back office financial accounting system using Microsoft's Navision product. Bob submitted an expert report on issues related to product performance and reliability. The case ran from July to November 2006 and was settled through mediation.
